MINUTES
CRISP COUNTY ZONING BOARD OF APPEALS
August 20, 2013

The Crisp County Zoning Board of Appeals met at a regular meeting on the 20th day of August at 9:00 am. in the Crisp County Government Center.
The following members were present: J.C. Clark, Lucky Taylor, Wendy Peavy and Jerry Carney. Absent was: Dale Mitchell. Also present, Connie Sangster, Crisp County Planning Director and Jimmy Mumphery, County Building Inspector. Also present were the following visitors: Luz Moreno, Dean Carron, Tabatha Bullington, Ila Bullington, Scott Sealy and Vickie McDaniel.

MINUTES

Chairman, J. C. Clark asked for a motion to approve the Minutes of the May 21, 2013 meeting.
VOTE: Motion was made by Wendy Peavy with a second by Lucky Taylor to approve the minutes of the May 21, 2013 meeting. Carried unanimously.

PUBLIC HEARING

Request from Luz Maria Moreno (with the property owners authorization) for a variance to locate a 2nd structure on a parcel of property that does not have the required lot width, or public street frontage. Property is zoned RR (Rural Residential) and is located at 2316 Truman Street.

Ms. Moreno was present and spoke on her own behalf. Ms. Moreno told the members that she would like to place a second mobile home on the property for her mother to live in. Mr. Taylor asked if she was going to place a singlewide or doublewide on the property. She stated that she did not know at this time, and did not want to buy anything until she knew she would be able to. Mr. Taylor asked her how much property did she own and if approved was she going to use the same septic tank and hook into your system. Ms. Moreno stated she had 3 acres, and would put in a new septic tank. Mr. Carney stated that this concern about the property is 2 things, 1 being the 30' easement, he stated that he went out to the property and even in his truck he had some doubts whether or not he would get to the property, even thought there is a two-lane mud road back to the property, his concern is about emergency vehicles getting back there, he stated they do have some information that states it may be doable but he is not too sure when he saw what he saw when he went out. He also stated that this is not a road and only an easement there and the reason why they have these rules and regulations is to avoid causing additional expense to the taxpayers, and he does have an issue with causing additional expense to emergency vehicles and that is a safety issue. Ms. Moreno stated that she has been living there for more than 1 year and they have been using that road to go in and out and have not had a problem. She stated that her husband has been trying to fix it and put gravel there, but have not had a chance to do so with all the rain. Ms. Moreno stated that UPS delivers packages at least one time a month and they have never had a problem, and the electricity company has not had a problem. She stated the ambulance came 2 times but it was the wrong address. Ms. Peavy asked how many other homes are on that easement. Mr. Mumphery replied only 1, Ms. Moreno's. Ms. Peavy asked if the land owners would be the ones to improve that road/easement. Mr. Mumphery replied yes. Ms. Sangster stated that the 30' easement is going to be purchased by Ms. Moreno and then it will be considered a part of her property instead of an easement. Mr. Carney stated so basically it is a private drive and he asked Ms. Moreno if she understood that the County has no responsibility in maintaining the 30' strip. Ms. Moreno replied yes. At this time Mr. Clark asked if there were other questions or comments. There were none. Mr. Clark stated that this concludes the public portion of the hearing and now they would go into discussion and vote.

MEETING

After discussion, the chairman asked for a motion.
VOTE: A motion was made by Lucky Taylor, with a second by Jerry Carney to approve the variance to locate a second structure on the property, provided, the driveway is improved to a minimum standard as determined by the Building Inspector. Carried unanimously.

PUBLIC HEARING

Request from Tabatha Bullington for a variance to locate a 2nd structure on a parcel of property that does not have the required minimum lot width or public street frontage. Property is zoned RR (Rural Residential) and is located at 394-4 Cemetery Road.

Chairman J.C. Clark called the hearing to order. Ila Bullington (Tabatha's) mother was present. Ms. Ila Bullington stated to the Board that she had been before the board about this piece of property before for her mother and the board approved it. She stated that she knew there was an issue about the road right now because of the front entrance. At this time, Mr. Clark told Ms. Bullington that this was a difference scenario and that she would have time to later in the meeting to talk. Tabatha Bullington stated that she wanted to come back home and that she wants to place a doublewide on the property for her and her 3 little puppies. Ms. Bullington stated that she knew the road was an issue and that for many, many years they have tried to get it straight and that is her intentions of trying to go back home. Mr. Taylor asked the dimensions of the lot. Ms. Bullington stated that it is 3.91 acres. Ms. Ila Bullington showed the members a plat of the property. Mr. Clark asked if she knew how wide the road is. Ms. Ila Bullington stated 50' wide. Mr. Clark stated that in passing when going home he has seen if a person is coming out onto Cemetery Road the person on the road has to wait for that person to come out before they are able to turn in. He stated that he did not go into the property to look because of the condition of the road and did not want to put his SUV on the road. Tabatha Bullington stated that there is 2 sides there but right now it is so full of water that you would be going through a pond. Ms. Ila Bullington stated there was a drive on each side of the tree and that the entrance way up to the green house is really bad. She stated she thought they had tried to fix it during the summer, they put dirt down but what it needs is some crush/run in there. She stated they had lived there for some 20 something years and there is a creek there and they used to get bogged down there all the time, but they went in there and put some crush rocks in there and some crush/run and once the heat gets on it it binds it together, and helps it from being so boggy. She stated that the road has actually gotten out further because the people in the trailer park has started using it and now it is real muddy and messed up and it used to be 2 little ditches down there and that helped the water to run out. Tabatha Bullington stated that when other people moved into the trailer park they used their access and they went over that hump which has made it worse and made the ditch close in so now the water wont run out. She also stated there is a dead tree that needs to be cut down before it falls down. Mr. Taylor asked if it is approved, are you going to be able to get a mobile home in there. Tabatha replied yes. Mr. Clark stated that he did not see how they would be able to get a mobile home in there. Ms. Ila Bullington stated that all this rain has really messed the road up bad this time and it is in the worse shape it has been in, in years. Mr. Taylor asked how can they allow this and balance their requirement to protect you. There would have to be some significant improvement to the road. He stated they have statements from the Fire Chief and EMS Director that they can't even access it. Ms. Ila Bullington stated that the front part has really gotten bad and that she is in the process of getting some prices together and see if all 5 that access the property cant fix it right. She stated her husband has a backhoe and they needed someone with a chainsaw to cut some trees down. Mr. Carney asked how long has this road been a problem. Tabatha Bullington replied that it has been an issue all of her life, they have always had problems with it. She stated that it had been fixed but is hard to maintain it. Ms. Ila Bullington stated that it had not been fixed properly. Mr. Clark asked them who gave them access to get back to their property. She stated they bought the 50' easement that goes back to their house, and it is a legal easement. Mr. Taylor asked if there were ones present in support of this request. Ms. Vickie McDavitt stated they paid last year to have it done with a tractor and then Larry Duckworth paid before she moved in years before and no one ever helped. Ms. Ila Bullington replied that they had never asked them to help, and that she was going to send out letters to all 5 property owners and have it fixed correctly. Mr. Carney stated that the road is an issue and they have solid documentation that there is no way he is going to take the risk personally to approve this when the emergency people stated they did not know if they could access the road in case of an emergency, and that the road needed to be fixed. Ms. Peavy stated that in 2006 it was an issue and here we are 7 years later and we are still talking about the same issue. Ms. Ila Bullington stated that the road would have to be fixed before they could put a trailer out there because the road was so bad. Mr. Clark asked if there were anymore questions. There were none. Mr. Clark stated that this concluded the public hearing portion of the meeting and now they would go into discussion and vote.

After discussion, the chairman asked for a motion.
VOTE: A motion was made by Jerry Carney, seconded by Wendy Peavy to table the variance request to locate a 2nd structure on a parcel of property that does not have the required lot width until the private drive is repaired and acceptable by the Crisp County Planning Department, Crisp County Fire Rescue and Crisp County EMS. Carried unanimously.
