MINUTES
CRISP COUNTY ZONING BOARD OF APPEALS
June 19, 2007
9:00 A.M.

The Crisp County Zoning Board of Appeals met at a regular meeting on the 19th day of June, at 9:00 a.m. in the Crisp County Courthouse. The following members were present: Emmett Walker, J.C. Clark, Frank Lott and Bob McCadams. Also present, Connie Sangster, Secretary & Planning Director & Jimmy Mumphery, County Building Inspector. Also present was the following visitors: Karen Register.

MINUTES

VOTE: Motion made by Bob McCadams, seconded by J.C. Clark to approve the Minutes of the May 15, 2007 meeting. Carried unanimously 3-0.

PUBLIC HEARING

Request from Karen Register for a variance to locate a 2nd structure (mobile home) on a parcel of property that does not have the required road frontage or acreage. Property located at 3891 Hwy. 280 E. and zoned RR (Rural Residential). Chairman Emmett Walker called the hearing to order. Mr. Walker read aloud the criteria in which variance requests are handled. Mrs. Register was present and spoke on her own behalf. Mrs. Register told the board that her son and his fiancé are presently living in the house with her and her husband and they are expecting a baby in October and they would like to locate a mobile home behind their house so they can have their own house and start their own family. She stated that she knew you had to have so much road frontage and acreage for a structure and they do not have that and they (her son) cannot afford to purchase any property right now to put a mobile home on and that’s what they want to do now, is to put it behind where they live. Mr. Walker asked if this was a permanent thing. Ms. Register replied probably not, they would probably be there for a few years, maybe 5 years or less, but did not think it would be permanent. Mr. Walker asked if the health department had been out yet? Ms. Register stated that she went to them on June 7th and applied for them to come out and check for a septic tank. She stated she had not heard from them, so she called this morning and they told her that they had called her earlier and told her there was a problem, but she stated that she had not talked with anyone. She stated that someone did come out when her husband was there, she thought it was Mr. Walker and someone came out to check for the underground wires or cable which was last Tuesday and she had not heard anything from the health department and that is why she called this morning to see if they would fax her a copy of the report and that was when she was told there was a problem, but she had not discussed it with anyone from the health department. They told her that since there was already two homes there and its only 1.41 acres. Ms. Register stated that is where her home is located but her dad's home is located next to her and he has already deeded her property over to her so its like 2.80 acres, but where their mobile home would be is right behind them on the 1.41 acres, so she is unsure what the issue is with the health department because she had not spoken with them before this morning, and that they wanted to get all of that done before this meeting this morning to make sure that everything was ok with the septic tank. Mr. Walker asked Ms. Sangster if this request fell under the family care. Ms. Sangster replied not really because it does not involve a sick or elderly parent, and they have applied for a hardship variance. Mr. McCadams asked the required acreage in the county now. Mr. Mumphery replied 11/2 acres per structure. Mr. Mumphery stated that Ms. Daniels with the health department did call the office this morning and that the reason they had not been to the property is because the lot size did not meet the county or state requirements regulations, and that is why they haven't done the septic tank permit until they have an approval or the approval is denied from this board. Ms. Register stated that she was told the same by the health department. Mr. Clark asked so if this board approves the request it still might not get a septic tank approval. Mr. Mumphery stated that he did not know if they were going to base their decision upon the approval from this board or not. Ms. Register stated that she understood that if this board approved the request then the health department would go out and do what they needed to do. Mr. Walker stated that he noticed the flags were out there where they were anticipating locating the mobile home; he then asked the size of the trailer. Ms. Register replied a 16x76. Mr. Lott asked if her father still lived in the house next door to their property. Ms. Register replied yes. He then asked about the easement on the plat. Ms. Register replied that is an easement for a private driveway for the Brown's that live in the back of them and they have already talked to them and they have no problem with her son using that driveway and there are two ways that they can get to the property. Mr. McCadams asked Ms. Register if she owned both lots, the one that she lives on and the one that her father is on. Ms. Register replied yes. Mr. Walker asked if we had anything for or against the request. Ms. Sangster replied that the Brown's called to inquire about the request and they had no objection to the request. At this time Mr. Walker asked if there were further questions. There were none. Mr. Walker stated that this concluded the public hearing portion of the meeting and now they would go into discussion and vote.

MEETING

After discussion, the chairman asked for a motion.
VOTE: A motion was made by Frank Lott, seconded by Bob McCadams to approve the request for a variance to locate a 2nd structure on a parcel of property that does not have the required road frontage or lot size, with the approval being contingent upon the Crisp County Health Department's approval for on-site sewage. Carried 3-1 with chairman voting. Property zoned RR (Rural Residential) and located at 3891 Hwy. 280 E.
